Introduction and Acceptance of Terms

These Terms of Use (the "Terms") govern your access to and use of the Liwanak Global platform, available at liwanak-global.com and related applications (the "Platform"). By creating an account, making a booking, listing a property, or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy and Cookies Policy, which are incorporated by reference.

Liwanak Global is an international accommodation platform connecting guests and hosts. If you do not agree to these Terms, you may not use the Platform.

Terms Applicable to Guests

1. Searching and Booking on Liwanak Global

The Platform allows you to search for, view, and book accommodation listed by hosts. Listing details, including price, availability, and house rules, are set by the host and displayed before you complete a booking. Once a booking is confirmed, it becomes a binding reservation between you and the host, subject to the host's cancellation policy and these Terms.

2. Cancellations, Booking Issues, Refunds, and Reservation Modifications

Cancellations, refunds, and changes to a confirmed reservation are governed by our Cancellation & Refund Policy, which forms part of these Terms. If you experience a problem with your accommodation, please contact the host and our support team as soon as possible so we can help resolve the issue.

3. Your Responsibilities and Assumption of Risk

You are responsible for reviewing listing details, house rules, and any requirements before booking, and for complying with them during your stay. You acknowledge that travel and accommodation carry inherent risks, and that Liwanak Global is not responsible for the condition of a property, the conduct of a host or guest, or events outside its reasonable control.

Terms Applicable to Hosts

4. Hosting on Liwanak Global

To list a property, you must have the legal right to offer it for short- or long-term accommodation and must comply with all laws, regulations, licenses, and permits applicable to your property and location. You are solely responsible for the accuracy of your listing and for the accommodation you provide.

5. Managing Your Listing

You control your listing's content, pricing, availability, and cancellation policy, which must be clearly and accurately presented to guests. You may update or remove your listing at any time, subject to any confirmed reservations already in place.

6. Cancellations, Booking Issues, and Reservation Modifications

Host-initiated cancellations and reservation changes are governed by our Cancellation & Refund Policy. Repeated or unusually frequent cancellations by a host may result in a review of that host's account, as described in that Policy.

7. Taxes

Hosts are solely responsible for determining and fulfilling any tax obligations arising from their use of the Platform, including any applicable income, occupancy, or value-added taxes in the relevant jurisdiction. Liwanak Global does not provide tax advice.

General Terms

8. Ratings and Reviews

Guests and hosts may leave honest, factual reviews about their experience. Reviews must not contain false statements, discriminatory content, or material unrelated to the stay. Liwanak Global may remove reviews that violate these Terms.

9. Content

You retain ownership of content you submit (such as photos, listing descriptions, and reviews), but grant Liwanak Global a non-exclusive, worldwide license to host, display, and distribute that content for the purpose of operating and promoting the Platform. You are responsible for ensuring you have the right to submit any content you upload.

10. Fees

Liwanak Global may charge service fees to guests, hosts, or both, in connection with a booking. Applicable fees are disclosed before a booking is confirmed or a payment is completed.

11. Platform Rules

You agree not to use the Platform for any unlawful purpose, to misrepresent your identity or a listing, to circumvent the Platform's payment or booking systems, to harass or discriminate against other users, or to upload content that infringes the rights of others. Liwanak Global may investigate and act on suspected violations of these rules.

12. Termination, Suspension, and Other Measures

Liwanak Global may suspend or terminate an account, or take other appropriate measures, where it reasonably believes these Terms, applicable law, or platform policies have been violated, or to protect the safety or integrity of the Platform and its users. Where reasonably possible, we will provide notice of such action.

13. Changes to These Terms

We may update these Terms from time to time to reflect operational, legal, or commercial developments. Updates apply to new bookings made after publication and, unless required by law, do not apply retroactively to bookings already confirmed. Continued use of the Platform after an update takes effect constitutes acceptance of the revised Terms.

14. Damage Claims and Compensation

A host may submit a claim for damage caused by a guest during a stay, supported by appropriate evidence. Liwanak Global may review such claims, request additional information from either party, and determine an appropriate resolution, which may include a deduction from a security deposit where one applies, in accordance with our Cancellation & Refund Policy.

15. Role of Liwanak Global

Liwanak Global provides a platform that connects guests and hosts; it is not a party to the accommodation contract formed between a guest and a host and does not own, manage, or control any listed property. Hosts are solely responsible for their listings and accommodation, and guests are solely responsible for their conduct during a stay.

16. User Accounts

You must be at least 18 years old and legally capable of entering into a binding contract to create an account. You agree to provide accurate information, keep your account credentials secure, and promptly update your account if your information changes. You are responsible for all activity under your account.

17. Identity Verification

We may require identity verification for certain accounts or transactions, for security, compliance, and fraud-prevention purposes. We may restrict access to certain features until verification is completed.

18. Disclaimer of Warranties

The Platform is provided "as is" and "as available." To the fullest extent permitted by law, Liwanak Global disclaims all warranties, express or implied, regarding the Platform, including the accuracy of listings, the condition of properties, and the conduct of users.

19. Limitation of Liability

To the fullest extent permitted by law, Liwanak Global shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Platform, or for the acts or omissions of guests or hosts. Nothing in these Terms limits liability that cannot be limited under applicable law.

20. Indemnification

You agree to indemnify and hold Liwanak Global harmless from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your use of the Platform, or your violation of any law or the rights of a third party.

21. Platform Operator

The Liwanak Global Platform is owned and operated by Liwanak Global (the "Platform Operator"). By using the Platform, you enter into a contractual relationship regarding its use with the Platform Operator, in accordance with these Terms. Liwanak Global may engage affiliated companies, payment processors, or other service providers to perform services on its behalf without affecting your rights or obligations under these Terms.

22. Dispute Resolution

If a dispute arises between you and Liwanak Global relating to the Platform, we encourage you to first contact our support team so we can attempt to resolve the matter directly. Liwanak Global will review complaints and disputes in good faith based on the information and documentation available.

23. General Provisions

These Terms, together with our Privacy Policy, Cookies Policy, and Cancellation & Refund Policy, constitute the entire agreement between you and Liwanak Global regarding use of the Platform. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision does not waive our right to do so later. The Platform may contain links to third-party websites or services that are not controlled by Liwanak Global and are governed by their own terms. Liwanak Global is not liable for delays or failures caused by events beyond its reasonable control (force majeure), including natural disasters, war, civil unrest, or disruptions to internet, telecommunications, or power infrastructure.
